Either a district or parent may file with OAH a Request for Due Process Hearing and Mediation.  Upon receipt, OAH will send to the other party and to the party requesting the hearing a Scheduling Order notifying the parties of the dates for prehearing conference, hearing, and the date by which the parties must submit a request for mediation.

 

To request a due process hearing and mediation a party should submit a request to OAH along with a Proof of Service showing that the request was sent to the other party or parties.  OAH provides optional forms – Request for Due Process Hearing and Mediation and Proof of Service – which may be found on the Forms page on this website.

To request OAH to set a mediation date the parties must submit a request to OAH.  OAH provides an optional form called Request to Set Mediation (and Continue Due Process Hearing) – 

which may be found on the Forms page on this website.

 

A proof of service is part of the optional forms so no additional proof of service is needed if the forms are used.  If the optional forms are not used, parties may wish to use the optional Proof of Service form, which may be found on the Forms page on this website.
