All state agencies are required to extend the useful life of surplus property in their possession following specific guidelines provided by the Department of General Services (DGS), Office of Fleet and Asset Management (OFAM), State Surplus Property Program (SSPP), which is responsible for reviewing and approving all state agency dispositions of state-owned surplus personal property prior to disposition.

Pursuant to the State Contracting Manual (SCM), Volume 2, Chapter 2 Procurement Planning, Topic 2 Surplus Property Program, state agencies shall utilize surplus furnishings whenever feasible and shall contact the SSPP to determine if surplus personal property is available.

The SSPP Warehouse is not open for public sales.

Disposal of State Surplus Personal Property

Before an agency’s disposal or transfer of any state-owned surplus personal property, other than vehicles and mobile equipment (see SAM Section 4111 and SAM Section 4112), the agency must obtain approval from the DGS OFAM SSPP.

The agency must prepare a Property Survey Report (STD 152) or a Transfers of Location of Equipment (STD 158) and submit it electronically to the SSPP via the California Surplus Property System (CSPS).

An agency can offer state-owned surplus personal property for sale to the public through an auction sale after the agency has offered the property for use within state services, to school districts, and after submitting a Property Survey Report STD 152 to the SSPR for review and approval.

After the successful bidder has paid for their items and presented the receipt, they shall be requested to sign a delivery receipt to signify that they have received the material. When scrap and junk is being sold, the person taking delivery shall either sign a delivery receipt or give the agency a receipt indicating the type and approximate quantity of material removed from the premises.

After the sale of material is completed, the amount of cash received shall be recorded on the approved copy of the STD 152, which is retained by the state agency.

Whenever public sales are conducted, a system of checks and balances shall be used. This shall, at a minimum, consist of having separate persons handle the sale and the collection of funds.

State employees may participate in public sales providing they do so in the same manner as the public. Employees may not use their position, office or prestige to their advantage when participating in sales of materials, nor may they participate on state time.

Where agencies identify surplus electronic equipment with no useful life remaining (E-Waste), agencies are required to use the services of a California Department of Toxic Substances Control (DTSC)-authorized E-Waste handler. More information is available on the DTSC website.

Media Sanitization

Agencies must sanitize all surplus electronic equipment in accordance with SAM Section 5365.3 prior to reutilization or disposal.

Resources

State departments are encouraged to reutilize surplus laptops and other portable computer equipment with authorized nonprofit entities that, in partnership with a school district, operate a public computer center to further the state policy of bridging the digital divide, as described in subdivision (a) of Section 709 of the Public Utilities Code, to be eligible for receipt of state surplus computers under Section 10389.1 and through approved disposition directly from a state agency. Reutilization of this equipment is enabled through the SSPP.

When state-owned surplus personal property is not being reutilized within state services, the agency shall electronically submit a STD 152 directly to the SSPP through the CSPS.

The agency must provide adequate information in the "explanation" section of STD 152 and indicate the reason(s) for disposal of the property.

The agency must use a single STD. 152 only for similar items or items being surveyed for the same reason. The agency must use separate STD 152s when surveying items for different reasons.

General Terms and Conditions

All vehicles and lot items are sold "AS IS," WHERE IS." There are no warranties (expressed or implied), adjustments, repairs, refunds, or exchanges. By bidding, buyer agree to indemnify and hold harmless the State of California from any and all damages, injuries, and/or causes of action which may involve any equipment, tools, or other goods occurring subsequent to the date of this sale. 

Items purchased from Bar None Auction must be picked up the week after the auction.  All pickups must be scheduled in advance. Auction lot hours are Monday through Friday from 8 AM to 4:30 PM.

All items must be removed from the auction facility at purchaser's sole cost and risk. 

Purchaser will accept any and all liabilities for damages to persons or property while removing items purchased.

All Vehicles will be issued an invoice, moving permit, or temporary license plate upon payment. Certificates of Title will be issued to purchasers for vehicles sold "WITH DOCUMENTS." all vehicles sold "WITHOUT DOCUMENTS" must be towed from the auction lot, a "JUNK" receipt will be issued to the purchaser, and a "SALVAGED" title will be issued by the Department of Motor Vehicles.

Purchasers will be locked from the GovDeals website unless a prior arrangement has been made for any item not removed within the five (5) business days allowed and stated on the Buyer's Certificate. 

All vehicles and lot items are sold “as is” and all sales are final.

TERMS: The following Terms and Conditions apply, GovDeals- Terms and Conditions.

NON-PAYMENT: Default shall include failure to make good and timely payment; or failure to remove all assets within the specified time.  Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured.  If the Buyer fails in the performance of their obligations.

FINAL PAYMENTS: Payment in full is due not later than five (5) business days from the time and date of the Buyers Certificate. Payment must be made electronically through the GovDeals Website. Acceptable forms of payment are PayPal, Wire Transfer, Visa, MasterCard, American Express, or Discover.

PICK UP: All pickups must be picked up within ten (10) days after an asset item has been won. Pick up times are Monday through Friday from 8:00 a.m. - 2:30 p.m., and appointment is necessary.
