DSA will hold a public meeting to receive proposals related to Accessibility to Public Buildings, Public Accommodations, Commercial Buildings and Public Housing for the 2027 Triennial Code Cycle (2028 California Building Code).

On September 28th 2024, Governor Newsom signed AB 3281 which amended Government Code (GOV) Section 4459, effective January 1, 2025. As amended, GOV 4459 permits:

  1. The State Architect shall develop amendments for building regulations and submit them to the California Building Standards Commission for adoption to ensure that no accessibility requirements of the California Building Standards Code shall be modified except as necessary for (1) aligning with existing state regulations that provide greater accessibility and features, or (2) meeting federal minimum accessibility standards of the federal Americans with Disabilities Act of 1990 as adopted by the United States Department of Justice, the Uniform Federal Accessibility Standards, and the federal Architectural Barriers Act, or (3) aligning with a provision improving accessibility and adopted in a national specification, published standard, or model code.

 

DSA is requesting public input to receive petitions and suggested code proposals aligning with GOV 4459. Suggested adopted national standards include ICC A117.1 (Formerly ANSI A117.1) Standards for Accessible and Usable Buildings and Facilities, Public Right-of-Way Accessibility Guidelines (PROWAG), and Medical Diagnostic Equipment Accessibility Standards.  This is not an exhaustive list.  Proposers must be able to provide the name of the standard and the section number that provides improved access.

 

On June 30, 2025, Governor Newsom signed AB 130 which amended the California Health and Safety Code (HSC) Section 18930, et al, to prohibit changes to the building code affecting residential units with certain exceptions, including standards necessary to align with minimum federal accessibility laws, standards, and regulations, until January 1, 2032.  DSA will receive proposals affecting residential facilities but will be required to assess individual provisions for alignment with minimum federal standards. Proposals may be held for future consideration.

The meeting will be held online using the Teams meeting platform and is also available by telephone.  Note that Teams is best used with a laptop or desktop computer.  No software is required to be loaded.  Cell phone or tablet users may notice a decrease in usability of the platform. No physical attendance will be available.  Attendees needing accommodations for a disability are required to make the request at least 48 hours prior to the meeting, to ensure availability.
