    Certifying Rulemaking

    Emergency Adoptions:  At any time, regardless of other ongoing code adoption activities, an action may be taken to adopt new or amended building standards by emergency action. State law restricts this authority to a true and defined emergency situation.  Normally, emergency adoptions are rare. State law allows for the adoption of emergency building standards that become effective immediately upon adoption and filing with the Secretary of State by CBSC. Following adoption, the state agency responsible for the emergency building standard must comply with all rulemaking requirements for public participation, hearings and final adoption. Otherwise, the emergency building standards expire after 180 days.
