Overview

In order to promote accessibility, DSA collaborates with stakeholders, experts and public entities to develop regulations that govern the construction of buildings in California. We propose changes to the California Building Standards Code (Title 24 Overview), as well as develop and publishing interpretations of code and policies and procedures necessary for stakeholder understanding and coordination of enforcement among the DSA regional offices. The building code becomes law when it's formally enacted by the appropriate authority. We are one of several state agencies that propose changes to the California Building and Administrative codes through the Building Standard Commission’s rulemaking process. The creation of regulation is directed through law. Regulations govern how the law will be enforced.

The Access Code Collaborative works cooperatively with DSA to offer input and feedback regarding amendments to the accessibility regulations of the California Building Code. More information on the group and its activities is located on the Access Code Collaborative webpage.

DSA is authorized by California statute to develop and propose building code regulations related to access for persons with disabilities to public buildings, public accommodations, commercial buildings and public housing. DSA Access Compliance (DSA-AC) develops and maintains the accessibility standards and codes used in public and private buildings throughout California. DSA proposes building code regulations in accordance with rulemaking processes administered by the California Building Standards Commission (CBSC). DSA-AC declares building regulations for making buildings, structures, sidewalks, curbs, and related facilities accessible to and usable by persons with disabilities. Access compliance regulations are applicable to:

  • Publicly funded buildings, structures, sidewalks, curbs and related facilities,
  • Privately funded public accommodations and commercial facilities, and
  • Public housing and private housing available for public use statewide.

The Division of the State Architect – Access Compliance (DSA-AC) will be conducting its pre-cycle activities for the 2018 Triennial Code Adoption Cycle. DSA-AC will hold two public stakeholder forums to solicit public comments and suggestions for potential amendments to the accessibility provisions of the California Building Code (CBC). DSA-AC has created a shortlist of potential amendments and is developing draft code language for each of these items. The draft code language will be presented and discussed during the public stakeholder forums. Based on public comments and staff analysis, DSA-AC will select items to be developed into formal code change proposals and submit its initial code change documents to the CBSC.

The CBSC code amendment process provides additional opportunities for public comments during the rulemaking cycle in the 45-day and any 15-day Comment/Challenge periods. After these comment periods, code change proposals submitted by DSA-AC will be considered for approval by the CBSC in December 2018 or January 2019. Approved changes to the CBC will take effect on January 1, 2020.

DSA-AC has no code change proposals presently submitted to the CBSC. Information about the 2019 Intervening Code Adoption Cycle is available on the CBSC website by selecting the desired phase of the code adoption cycle.

DSA-AC accepts code change suggestions on an ongoing basis. If you would like to suggest a code change amendment for DSA’s consideration, you may complete form DSA 665: DSA Code Amendment Proposal and submit it via email attachment to DSAAccess2019@dgs.ca.gov.

Second Day (July 10) of the Access Code Stakeholder Forum Will Not Take Place

The California Division of the State Architect (DSA) held a public meeting on Tuesday, July 9, 2019 and completed its review of the proposals on the agenda; therefore, the Wednesday, July 10, 2019 meeting will not be held as advertised.  Individuals wanting to make comments related to the proposed amendments are welcome to submit comments to DSAAccess2019@dgs.ca.gov.

DSA will once again present initial drafts of proposed code amendments to the accessibility provisions of the California Building Code and solicit public input regarding these items in September.  Meeting agenda, date, time and location to be provided approximately two weeks before the scheduled meeting. DSA is working with interested individuals and organizations as members of the DSA DWR Task Force to provide advice, review and commentary during the process to develop proposed code change amendments for Chapter 11B. CODE CHANGE PROPOSALS

DSA-AC has no code change proposals presently submitted to the CBSC. Information about the 2018 Triennial Code Adoption Cycle is available on the CBSC website by selecting the desired phase of the code adoption cycle.

Building Standards Commission Review - December 4 & 5, 2018

DSA-AC has submitted code change proposals to the CBSC for review and approval. These items will be reviewed and discussed at the December 4 & 5, 2018 CBSC meeting.

15-Day Comment Period – October 31, 2018 through November 15, 2018

DSA-AC has submitted code change proposals to the CBSC for their 15-day public comment period. These items will be reviewed and discussed at the CBSC meeting to be scheduled at a date near the end of the current adoption cycle. A meeting notice will be issued announcing the date, time and location of the public meeting. Written comments will be accepted by the CBSC from October 31, 2018, until 5:00 PM on November 15, 2018. CBSC Code Advisory Committee Meeting – July 24, 2018

DSA-AC has submitted code change proposals to the CBSC. These items will be reviewed and discussed at the CBSC Code Advisory Committee (CAC) meeting scheduled for July 24 and, if necessary, July 25, 2018. Public comments may be submitted to the CBSC prior to the meeting or may be presented verbally during the meeting.
